The Orphans’ Court Procedural Rules Committee was established under Article V, § 10(c) of the 1968 Pennsylvania Constitution and 42 Pa. C.S., § 1772. It responds to developments in Orphans’ Court procedure and reviews current rules governing statewide practice and procedure in the Orphans’ Court, recommending new rules as necessary. The committee also responds to appropriate inquiries and suggestions made by lawyers, trial and appellate judges and justices, court officials and personnel, and the public. Questions from, and suggestions by, such persons are often studied in depth by the committee and may result in recommendations to the Supreme Court for new rules or amendments to existing rules. The committee also receives and responds to requests from the Supreme Court, either directly or through suggestions in cases, to address issues of particular interest to the court. Committee recommendations are generally published for comment except where there are exigent circumstances or the change is ministerial in nature.
