Clerk Ordered to Stop Issuing Same-Sex Marriage Licenses

Commonwealth Court President Judge Dan Pellegrini has granted the state Department of Health’s petition seeking to compel Montgomery County Register of Wills D. Bruce Hanes to stop issuing marriage licenses to same-sex couples.
The court’s ruling granted the amended application for summary relief filed Aug. 5 by the Commonwealth of Pennsylvania, the Department of Health with the Commonwealth Court. Argument on the matter was held in Commonwealth Court Sept. 4 at the Pennsylvania Judicial Center before President Judge Pellegrini.
Today’s order is accompanied by a 34-page opinion outlining the court’s findings.
